Lets assume the total capacity is x lit.
5% empty means 95 % filled.
Therefore (95/100) x = 38 lit -----> x= (38/95)*100 lit -----> x= 40 lits.
Therefore to fill the tank petrol needed to be poured is (40-38)= 2 lit.
